MotionX-GPS Overview

The most accurate and reliable solution for the iPhone, MotionX-GPS embeds the functionality of an advanced hand held GPS unit into a simple and intuitive iPhone application.

Track outdoor activities such as hiking, running, sailing, geocaching and biking using MotionX-GPS with your iPhone 4, 3GS or iPhone 3G. The application is ideal for geocaching enthusiasts. It's full-featured, easy-to-use and provides the ability to share the coordinates of your geocaches with others.

Location Modes:
The signal indicator icon in the upper right corner of the page indicates current GPS signal status. Touch this signal indicator at any time to toggle between Outdoor GPS Mode, WiFi/Triangulation Mode, and Manual Mode.

Search/Map Button:
The Search/Map button at the bottom left of MotionX-GPS allows you to quickly toggle between the Search and Map pages. From the search page, choose one of the search methods from the wheel to find a destination to navigate towards, or a track to follow. The corner buttons provide quick access to the Track Recorder, Compass, Sharing and Resume Nav. The wheel offers the following options:

iPod Button:
iPod media controls are available from any page using the iPod button at the bottom of the page. Press once to bring up the iPod controls and press again to hide. Many of the iPod controls from the native iPod are available including Play/Pause, Next Song, Previous Song, Repeat and Shuffle. In addition, album art, song name and artist are displayed to show you what's currently playing.

Compass

When the compass rose (8 point star) icon is displayed in the middle of the compass, the built in magnetometer in the iPhone 4 or 3GS is being used to display True North. This mode does not apply to the iPhone 3G as it does not have a magnetometer. Press the center of the compass to toggle between the three modes of operation: magnetic compass, GPS-based compass heading, or auto-mode.

 

When the sextant icon is displayed in the middle of the compass, the built in magnetometer in the iPhone 4 or 3GS is used below 5mph and orderly changes in position from your GPS signal are used above 5mph. This mode does not apply to the iPhone 3G as it does not have a magnetometer.
When a grey icon with "GPS" in the middle of the compass is displayed, orderly changes in position from your GPS signal are being used to display true north. This mode is used anytime you're moving more than a few mph or km/h on the iPhone 3G and is an option on the iPhone 4 or 3GS.

 

When this red 'No Heading Signal' icon is displayed in the middle of the compass, no heading signal is present. The compass heading will point North until a heading signal is acquired.

 

When this yellow 'Inaccurate Heading' icon is displayed in the middle of the compass, heading accuracy is below 85%. Sustain a speed of more than a few mph (or km/h) to maintain an accurate heading.

 

This red arrow indicates the direction of travel.

 

This blue arrow indicates the bearing to the selected waypoint. If no waypoint has been selected this arrow will not be present.

Map

The map page offers several map types and orientation options (Direction Up, Course Up, and North Up) to view your waypoints or plot your tracks.

Controls: Tracks Lines and Symbols: Signs:

If there are 31 or more waypoints or POIs in view, they will be displayed as dots. Between 15-30, pins are used. If 14 or fewer, rectangular signs are displayed.

Map Downloads and Map Caching

Map Downloads and Map Caching are two similar but distinct features. Both improve map performance and enable you to use maps even when your iPhone's data connection is unavailable. Due to the licensing agreements with our map providers, Map Downloads and Map Caching are available exclusively for MotionX Road, MotionX Terrain and NOAA charts.

Use Menu>Setup>Map Downloads to define an area of the map along with a range of zoom levels to pre-load for offline use when a network connection is unavailable. Once selected and downloaded, these tiles will be saved in MotionX-GPS permanently unless you choose to delete them from the Map Downloads page.

You can see overview of any map tile set you've downloaded by going to Menu>Setup>Map Downloads, selecting any one of My Maps then pressing the View button, but to actually use the maps you've downloaded, simply go to the main Map page. The View page is simply a reminder of which area you've downloaded.

In contrast to Map Downloads, Map Caching automatically saves tiles that you view on the Maps page as you scroll and zoom the map when a network connection is available. New tiles will be saved in MotionX-GPS until you reach the cache limit of 250 MB. The oldest cached tiles will then be overwritten as new tiles are cached. Your cached maps can be cleared at any time by going to Setup>Maps>Clear Cache.

From Menu>Setup>Maps, you can enable the backup of your maps in iTunes. Due to the long sync times you'll encounter when backing up map tiles in iTunes, we strongly recommend only enabling this feature if you plan to restore your device and don't want to redownload your maps.

Map Downloads Instructions:
1. One can initiate the Map Downloads workflow from two locations.
2. Next, choose between MotionX Terrain, MotionX Road, or NOAA Marine Experimental as the map type you wish to pre-load.

3. A map area selector will display over the map. The "Select by Area" button is selected by default. Alternatively the "Select by Route" option can be chosen to specify longer areas more appropriate for point A to B routes. Once satisfied with the area selected, press the Next button. 4. The next page displayed will allow you to name the downloaded map set and adjust the zoom level range. We recommend that you be selective when choosing the area and zoom levels, as extensive areas of fully detailed maps can take a very long time to download.
5. Select the Download button to start downloading map tiles. Download times are best when using WiFi, but 3G and Edge are also supported. The progress bar will turn green and indicate "Download Completed" when finished. If needed, press the "Pause" button to stop the download. Select "Resume" to continue downloading. If the download was interrupted by a loss of network connection or by closing MotionX-GPS, use the "Resume" button to complete the map tile set download.

Please note: If running iOS4 and downloading map tiles in the background, set your signal mode to Outdoor GPS Mode or WiFi/Triangulation Mode. Under Setup>Multitasking, also set your GPS signal search to Always On. The reason for this is that iOS4 will terminate the downloading of map tiles after 10 minutes if the location services are not being used.

The following options are available once a map tile set has been downloaded, or when download is paused: MotionX-GPS will store as many map tile sets as your iPhone has available storage space for, up to 50 map tile sets and up to 1 million tiles per set. To view all downloaded and partially downloaded map sets, go to Menu>Setup>Map Downloads.

Map Caching:
Map caching improves the performance of the Maps page by loading map tiles faster when using the MotionX Terrain, MotionX Road, or NOAA Marine Experimental map types. Map tiles that are downloaded and viewed when map caching is turned on will subsequently load faster. If you lose a network connection, cached map tiles remain available. If you've used Map Downloads to download map tiles, your map tiles for that area are already cached.

To cache your maps, first turn map caching on from Menu>Setup>Maps. Go to Menu>Map, select either MotionX Road, MotionX Terrain, or NOAA Marine Experimental maps, then pan around or change zoom levels to add to your cached maps. When you've reached the map cache limit of 250 MB, MotionX-GPS will automatically purge your oldest map tiles.

Cached tiles remain on your device until you manually clear them using the “Clear Cache” button under Menu>Setup>Maps, or until the tiles are purged as they are overwritten with new tiles. Therefore, if you make edits to the OpenStreetMap database you need to clear your cached maps and revisit the map area that was edited for the updated tile(s) to download to your device. Please note that updates may take up to two weeks before they proliferate through the map servers.

Clearing your map cache does not delete your downloaded map tile sets from Menu>Setup>Map Downloads.

Map caching is supported exclusively for the MotionX Road, MotionX Terrain, and NOAA Marine Experimental maps. Other map options supported do not allow map caching due to licensing restrictions.

Tracks

The Tracks page contains a summary of your recorded tracks. A track is a compilation of location samples or "breadcrumbs" taken over a period of time during your trip. To record your tracks and save them to the Tracks page, use the Track Recorder. From the Tracks page, selecting an existing track brings up a split view with basic info about the track and an optional photo on top and a map showing the track on the bottom. Select View Details to display the Elapsed Time, Avg Speed, Distance, Max Speed, Track Name and Notes. Swipe the bottom portion of the page up and down to move between speed/distance data, speed graph, altitude/elevation graph and gradient/ascent/descent data. The graphs can also be flicked left to right to see plotted data from longer tracks. Tap and hold on a graph to display your speed or altitude at any point along the graph (requires iOS 4). To edit the name or notes, just touch the text and enter any changes.

Track Options: Select a track to view the track details and access the Options menu.

All Tracks: Contains all tracks you've recorded.

Selecting the New Track button from the Tracks page brings up the Track Recorder so you can record a new track.

Waypoints

A waypoint is a set of coordinates that uniquely identifies a geographic location. A waypoint has a latitude, a longitude and an optional altitude. If UTM is chosen from Menu>Setup>Display, it will be comprised of an Easting, a Northing, and a Zone. If MGRS is chosen from Menu>Setup>Display, it will be comprised of a Grid Zone, Meter Square Identifier, an Easting and a Northing. If OSGB is chosen from Menu>Setup>Display, it will be comprised of a Grid Square, an Easting and a Northing. Touch any saved waypoint to see it on a map, then select Details to bring up detailed information such as the name, notes, bearing, altitude, distance, latitude and longitude.

Waypoint categories and folders:

Waypoints are broken up into the categories: All Waypoints, Auto Waypoints and Home Waypoint. Waypoint Folders allow you to group waypoints from a specific activity or trip together. Included are folders for Recently Added, Import and Points of Interest or you can create your own custom folders.

Waypoint details page:
Selecting an existing waypoint brings up a split view with basic info about the waypoint and an optional photo on top and a map showing the position of the waypoint on the bottom. Select View Details for additional information. The Name, Notes, Altitude, and coordinate fields can be edited by selecting the field you wish to edit. Bearing and Distance figures are based on the waypoint's location relative to your current location. Press the blue Options button in the upper right to bring up the following actions:

Import Instructions:

  1. To import waypoints or tracks, send an email from your Mac or PC with one or more GPX files attached to gpsimport@motionx.com.

  2. You will receive an email, which should be viewed from your iPhone Mail app.

  3. Select the link in the email and MotionX-GPS will launch and provide a summary of the number of items that will be imported

  4. Select "Import Now" and the waypoints or track will be imported.

Note: Forwarding an email with a GPX file from your iPhone to gpsimport@motionx.com is supported, but composing a new email from your iPhone with an attachment is not supported by the iPhone OS. This must be performed from a Mac or PC. Import emails are limited to 12 waypoint GPX files or 1 track GPX file per email.

New Waypoint Button:

Selecting the New Waypoint button from the Waypoints page creates a new waypoint with your choice of five methods.

Glossary of Terms


Geotagged Images:
Geotagging is the process of adding geographical identification metadata to media such as photos. This data typically consists of latitude and longitude coordinates. Geotagging allows you to view the location where a photo was taken. EXIF viewers, photo management software and social networks can utilize this data to place your photo at the correct location on a map.

UTM (Universal Transverse Mercator):
A grid based coordinate system used for specifying locations on the surface of the Earth. The UTM grid is comprised of 60 zones, each of which is based on a specifically defined transverse Mercator projection. For additional information, see Wikipedia.

MGRS (Military Grid Reference System):
Geocoordinate standard used by NATO militaries for locating points on the earth. The MGRS is derived from the UTM (Universal Transverse Mercator) grid system, but uses a different labeling convention. MotionX-GPS supports MGRS coordinate entry from a precision level of 10km through 1 meter. A valid MGRS coordinate consists of a Grid Zone that must be two digit number 01-60 followed by one letter A-X but not I or O. Meter Square Identifiers must be two letters. Easting and Northing values must be of the same length, consisting of 1-5 digits each. For additional information, see Wikipedia.

OSGB (Ordnance Survey Great Britain):
The Ordnance Survey National Grid is a system of geographic grid references used in Great Britain based on the OSGB36 datum. The two letter grid square identifies a 25km by 25km square. Within each square, eastings and northings define the distance in meters from the south west corner.

Magnetic North:
This is the direction a magnetic compass needle points towards.

True North:
This is the direction along the Earth's surface towards the geographic North Pole.

Rhumb Line:
A line on a sphere that cuts all meridians at the same angle. When navigating using Rhumb Line, the path taken maintains a constant compass direction.

Great Circle:
Any circle drawn around the Earth such that the center of the circle is at the center of the earth. The shortest distance between any two points on the earth lies along a great circle.

GPX (GPS eXchange format):
An open format used for describing GPS data between software applications.

KML (Keyhole Markup Language):
A format used for describing GPS data between software applications. KMZ is the zipped form of KML. KML was developed for use with Google Earth, but many other software applications have adopted KML/KMZ as well.

Accelerometrics:
A term coined by the MotionX team to describe the use of accelerometers to improve upon the accuracy of the GPS signal. This is especially beneficial for low speeds such as walking, hiking and running.

Map Caching
Map caching improves the performance of the Maps page by loading map tiles faster when using the MotionX Terrain, MotionX Road, or NOAA Marine Experimental map types. Map tiles that are viewed when map caching is turned on will load faster when loaded again. If you loose a network connection cached map tiles are available as well. If you've used Map Downloads to download map tiles, your map tiles for that area are already cached. To cache your maps, first turn map caching on from Setup>Maps. Go to the Maps page, select either the MotionX Road, MotionX Terrain, or NOAA Marine Experimental maps, then pan around or change zoom levels to add to your cached maps. When you've reached your map cache limit of 250 MB, MotionX-GPS will automatically purge your oldest map tiles. Q1. What can I do if I'm having trouble acquiring a signal?

A Track is a series of points recorded during your journey.

Q3. How do I create a track?
Tracks are recorded while the Track Recorder is running. You can save a track to your Tracks page by using the Start, Pause and Save buttons on the Track Recorder page.

Q4. How do I export my waypoints and tracks?
You can export your waypoints and tracks by email, post to your Facebook wall or send via Twitter. Go to the Waypoints page or Tracks page, touch the waypoint or track you wish to export, then touch the Share button.

Q5. What is included in the email when I use the "Share" feature?
The email contains a link for viewing your track or waypoint in Google Maps. In addition, you will find a photo (if you assigned one to this track/waypoint) as well as KMZ and GPX files. The KMZ file can be imported into Google Maps or Google Earth on your PC or Mac. The photo you assigned to this track/waypoint will also be contained in the KMZ file. The GPX file can be imported into Google Earth or your favorite mapping software on your PC or Mac. For more information on Sharing, view the Share section.

Q6. How do I import waypoints and tracks?
Importing of GPX waypoints and tracks into MotionX-GPS is supported in version 7.1 or later (Full version only). See the Import section above for instructions.

Q7. What file types can I import into MotionX-GPS?
The import feature supports waypoints and tracks only in the GPX file format. If you have a waypoint or track in a different file format, use a file converter such as GPSVisualizer or GPS Babel to convert to GPX.

Q8. When importing, how many GPX files can be attached to the email?
Each import email can contain 12 waypoint GPX files or 1 track GPX file.

Q9. Are there file size constraints for the GPX files to be imported?
Our servers don't impose any hard file size constraints on the imported GPX files. The restriction is the amount of available RAM on your iPhone. For 3G users this is typically 5MB when MotionX-GPS is running. For 3GS or iPhone 4 users it can be more. If a GPX file is over 1MB, you may want to reboot your iPhone before importing to ensure there is enough iPhone RAM available for the import.

Q10. If importing a GPX file from a photo waypoint, will the photo be imported into MotionX-GPS?
Not at this time, but look for this functionality in a future update.

Q11. How do I toggle between North Up, Course Up, or Direction Up on the Map page?
Press the location arrow button between the zoom controls on the Map page to switch to Course Up or Direction Up. Course Up and Direction Up options are exclusive to the MotionX Road, MotionX Terrain, and NOAA Marine Experimental map types. Google Maps do not support these features. Direction Up is only available for the iPhone 4 or 3GS as the 3G iPhone does not contain a digital compass.

Q12. Can I get turn-by-turn driving directions?
MotionX-GPS does not provide driving directions. Try our other navigation application MotionX-GPS Drive if you're interested in tury-by-turn guidance while driving. Search for MotionX-GPS Drive in the App Store.

Q13. Can I get verticals climbed in a track?
You can view an altitude graph, the current altitude, ascent, descent and the current gradient from the Track Recorder by swiping the bottom half of the page. Swipe up and down to switch between pages and left to right to pan through longer graphs. This data is also available from the details view of saved tracks. Tap and hold on a graph to display your speed or altitude at any point along the graph (requires iOS 4). If you have a Facebook account, you can view elevation charts by installing the MotionX-GPS Facebook application available from the MotionX-GPS fan page.

Q14. What happens when a phone call comes in?
Apple shuts down all third party applications when a call comes in. MotionX-GPS saves your current state and once the call is finished, you are returned to where you were. Your track recorder will still be running and we will include the distance between the last point before the call came in and your current location. However, it will be calculated based on a straight line since the GPS signal is not available during a call.

Q15. How can I save power?
By turning off Wi-Fi and Bluetooth when not in use and dimming the screen brightness from within your iPhone's Settings, you can reduce power consumption. In addition, turning off Accelerometrics Assisted GPS from Setup>General will further reduce power consumption.

Q16. How long will my iPhone's battery last?
This depends on many factors such as WiFi, Bluetooth, inbound emails and push notifications, but typically at least 4 hours for a 3G or 3GS and up to 8hrs with an iPhone 4. See above for suggestions on extending battery life.

Q17. Do you have a website for all my tracks and my waypoints?

Q18. What formats can I use to enter coordinates?
Coordinates can be entered in Degrees/Minutes/Seconds via the provided wheels. Alternatively, you can choose direct entry using the keyboard for greater input accuracy in either Degrees with decimal Minutes (DM), or Decimal Degrees (DD). Universal Transverse Mercator (UTM), Military Grid Reference System (MGRS) and Ordnance Survey Great Britain (OSGB) coordinates are also supported if chosen as the coordinate display format from Setup>Display. You can also add a waypoint using TapTap® technology on the map page or by specifying a range and bearing from your current location.

Q19. Is MotionX-GPS performance affected by other applications?
Occasionally apps that can run in the background, such as Mail, may affect the performance of MotionX-GPS. The user interface may become slow while large emails are being downloaded in the background. If the interface is slow and there aren't any inbound emails, your iPhone is likely low on RAM. A reboot will resolve the low memory condition.

Q20. How do I clear old tracks from my Map page?
To clear old tracks currently drawn on the Maps page, go to the Maps page, select the Maps button, then select Edit Tracks>Clear Tracks from the menu. This will erase the track data from the Map page, but does not affect tracks saved to the Tracks page.

Q21. What datum does MotionX-GPS use?
MotionX-GPS uses the WGS84 datum.

Q22. What is the difference between cached maps and downloaded maps?
Downloading maps and map caching are two similar but distinct features. Both improve map performance and enable offline map viewing. Map caching automatically saves tiles viewed on the Maps page as you scroll and zoom. The cache limit is 250 MB; beyond this limit the oldest cached tiles are overwritten as new tiles are cached. Downloaded maps are downloaded using the Download Maps tool from within MotionX-GPS, where you define a specific region and range of zoom levels for downloading and storage. Downloaded map tile sets are stored on your device until you delete them.

Q23. What zoom levels should be selected when downloading maps?
The Min Zoom level (smaller numbers) gives a broader overview. The Max Zoom level (higher numbers) provides greater detail. Higher zoom levels for a given area result in more map tiles. The zoom level is displayed in the lower right corner on the Map screen. Since it can take a significant amount of time to download the max zoom level across large areas, we recommend downloading an overview of the areas you're interested in using zoom levels 10-12, then in a separate download, select smaller areas in which to download greater detail at higher zoom levels.

Q24. Where can I view the maps I've downloaded, and how do I know they will be available without a data connection?
You can view an overview of a specific map set you've downloaded from Menu>Map Downloads>View. If you wish to verify that your map tiles are available offline:
  1. Turn off Map Data from Menu>Maps>Map Data.
  2. Go to the Map screen.
  3. Select the same map type that you downloaded (i.e. Road, Terrain, or Marine).
  4. Zoom out and pan to identify the lowest zoom level downloaded, then zoom in to view higher map tile zoom levels.
Q25. Why are some map tiles missing above 60 degrees North Latitude?
The MotionX Terrain map we offer is by OpenCycleMap (OCM) and they don't currently have elevation data above 60 degrees N latitude. OCM uses a digital terrain model based on the Shuttle Radar Topography Mission (SRTM), which according to NASA's site is the most complete high-resolution digital topographic database of Earth. We apologize for the inconvenience to those living above 60 degrees N. There has since been a more comprehensive NASA mapping mission called ASTER, but this data is still being refined. We are always working to add additional map types so please keep an eye out for our frequent app updates.

Q26. When using the Map Downloads feature, how do I prevent the downloading of map tiles from stopping when MotionX-GPS is running in the background?
If running iOS4 and downloading map tiles in the background, set your signal mode to Outdoor GPS Mode or WiFi/Triangulation Mode. Under Setup>Multitasking, also set your GPS signal search to Always On. The reason for this is iOS4 will terminate the downloading of map tiles after 10 minutes if the location services are not used.

Q27. Are cached and downloaded maps backed up when MotionX-GPS is sync'd with iTunes?
From Menu>Setup>Maps, you can enable the backup of your maps in iTunes. Due to the long sync times you'll encounter when backing up map tiles in iTunes, we strongly recommend only enabling this feature if you plan to restore your device and don't want to redownload your maps.

Q28. Does MotionX-GPS work when my iPhone 4, iPhone 3GS or iPhone 3G is in airplane mode?
No unfortunately not. When in airplane mode, the GPS chipset is disabled by the iPhone. Third party iPhone applications cannot override or alter the Airplane Mode functionality to enable the GPS chipset. If you want to ensure network data is not used while using MotionX-GPS, remove your SIM card (the SIM is located in a slot on top of your iPhone -- you will need a narrow pin to pop the card out). The A-GPS (Assisted GPS) chipset in the iPhone 4, 3GS and 3G is designed to use cellular or WiFi data to speed up the acquisition of your GPS signal, so you may need to wait 15 minutes or longer to acquire a signal if your SIM has been removed.

END-USER LICENSE AGREEMENT

This is a legal agreement between you and Fullpower® Technologies, Inc. (“Fullpower”) regarding your use of the MotionX™‑GPS software and all data or content that is accessed or utilized by the MotionX™‑GPS software (collectively the “Software”). By installing or using the Software, you agree to be bound by the terms of this End-User License Agreement (this “EULA”). If you do not agree to the terms of this EULA, you are not entitled to use the Software and must uninstall the Software from all of your devices.

License. Subject to the terms and conditions of this EULA, Fullpower grants you a non-exclusive, non-transferable, non-assignable license (without right of sublicense) to install and use one copy of the Software on your personal mobile device, and to maintain one backup copy of the Software on your personal computer, solely in machine executable object code form and solely for your personal use.

Restrictions. The Software and any related documentation are protected by United States copyright law and international treaty provisions. You may not copy, modify, adapt, translate into any language, distribute, or create derivative works based on the Software without the prior written consent of Fullpower. You may not assign this EULA or any of the rights or licenses granted under this EULA or rent, lease, or lend the Software to any person or entity. You agree not to decompile, disassemble, reverse engineer, or attempt to reconstruct, identify, or discover any source code, underlying ideas, underlying user interface techniques, or algorithms of the Software by any means whatsoever, except to the extent the foregoing restriction is prohibited by applicable law.

Ownership. The Software is licensed, and not sold, to you under this EULA. You have no ownership rights in the Software, Services or any related documentation. Fullpower and its suppliers retain all right, title, and interest in and to the Software and Services (including any changes, modifications, or corrections thereto) and any related documentation.

Suggestions. If you elect to provide or make available to Fullpower any suggestions, comments, ideas, improvements, or other feedback or materials related to any Fullpower product or otherwise (collectively, “Suggestions”), Fullpower will be free to use, disclose, reproduce, modify, license, transfer and otherwise utilize and distribute your Suggestions in any manner. You will be entitled to no compensation or credit for, nor gain any right, title or interest in or to, any Fullpower product that incorporates or otherwise is based on your Suggestions, including without limitation any upgrades or changes to the Software or Services.

Uploads. The Software may provide functionality through which you are able to upload information (such as images, waypoints and tracks) about your use of the Software (collectively, “Uploads”) to Fullpower’s servers and to notify others about the availability of your Uploads, for example by sending an email or posting to a social networking site such as Facebook or Twitter (the “Upload Service”). If you use such functionality, you authorize Fullpower to retain your Uploads on its servers, to reproduce, publish and make your Uploads available to anyone you notify (whether directly or indirectly, such as via a social networking site) about the availability of your Uploads, and to disclose the user name you submitted with your Uploads. In addition, if you elect to share your Uploads with the MotionX community, you authorize Fullpower to retain your Uploads on its servers, to reproduce, publish and make your Uploads available to any third party, and to disclose the user name you submitted with your Uploads. In addition to the Upload Service, the Software may provide functionality through which you are able to receive other services from Fullpower (such other services and the Upload Service, collectively, the “Services”). Fullpower will have no obligation to provide any Services, may change the form and nature of any Services at any time with or without notice to you, will have no liability whatsoever to you or any third party for any failure of the Software or Services to transmit your Uploads to or from Fullpower’s servers, may cease providing any Services at any time with or without notice to you, and will have no obligation to retain your Uploads (or any other materials you may provide to Fullpower) on its servers or return your Uploads (or any other materials you may provide to Fullpower) to you before deleting them from its servers.

Storage. The Software may provide functionality through which you are able to store information (such as images) on the device on which you are using the Software. Fullpower will have no liability whatsoever to you or any third party for any failure of the Software to store any such information on such device.

Personal Information. By using the Software, you agree to the collection, retention and processing of your personal data (including the location of your mobile device) by Fullpower and its suppliers and to the storage and processing of such personal information on computers located both inside and outside of the country in which you reside. Even though Fullpower has taken steps intended to protect your personal information from being intercepted, accessed, used, or disclosed by unauthorized persons, Fullpower cannot fully eliminate security risks associated with your personal information and cannot guarantee that its systems will not be breached. Disclaimer of Warranty. THE SOFTWARE AND SERVICES ARE PROVIDED “AS IS” AND “WITH ALL FAULTS” AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE AND SERVICES IS WITH YOU. SHOULD THE SOFTWARE OR SERVICES PROVE DEFECTIVE, FULLPOWER DOES NOT HAVE ANY LIABILITY FOR THE SERVICING AND/OR REPAIR OF YOUR DEVICE OR THE SOFTWARE. FULLPOWER AND ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES WITH RESPECT TO THE SOFTWARE AND SERVICES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR USE OR PURPOSE. FULLPOWER AND ITS SUPPLIERS DO NOT WARRANT THAT THE SOFTWARE OR SERVICES WILL MEET YOUR REQUIREMENTS IN ANY RESPECT, OR THAT THE OPERATION OF THE SOFTWARE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ERRORS IN THE SOFTWARE OR SERVICES OR NONCONFORMITY TO ITS OR THEIR DOCUMENTATION CAN OR WILL BE CORRECTED. YOU ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION ARE A MATERIAL INDUCEMENT AND CONSIDERATION TO FULLPOWER AND ITS SUPPLIERS TO GRANT THE LICENSE CONTAINED IN THIS EULA AND TO PROVIDE YOU WITH ACCESS TO THE SERVICES.

Use of MotionX-GPS is at the User's Own Risk. THE SOFTWARE AND SERVICES ARE NOT FAA CERTIFIED AND MUST NOT BE USED FOR PRIMARY NAVIGATION. THE SOFTWARE AND SERVICES MAY NOT BE USED FOR SAFETY OF LIFE APPLICATIONS, OR FOR ANY OTHER APPLICATION IN WHICH THE ACCURACY OR RELIABILITY OF THE SOFTWARE OR SERVICES COULD CREATE A SITUATION WHERE PERSONAL INJURY OR DEATH MAY OCCUR. DO NOT ATTEMPT TO CONFIGURE THE SOFTWARE OR INPUT INFORMATION WHILE DRIVING. FAILURE TO PAY FULL ATTENTION TO THE OPERATION OF YOUR VEHICLE COULD RESULT IN DEATH, SERIOUS INJURY, OR PROPERTY DAMAGE. Limitation of Liability. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FULLPOWER OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTIONS, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS EULA, YOUR USE OF OR INABILITY TO USE THE SOFTWARE OR SERVICES, OR YOUR USE OF OR RELIANCE ON ANY DATA (INCLUDING GPS DATA) YOU MAY ACCESS IN CONNECTION WITH YOUR USE OF THE SOFTWARE OR SERVICES, EVEN IF FULLPOWER OR ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Exclusions. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that Fullpower may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of Fullpower’s liability shall be the minimum permitted under such applicable law.

Termination. This EULA is effective until it is terminated. You may terminate this EULA at any time by destroying all copies of the Software and related documentation in your possession or under your control. This EULA will automatically terminate if you violate any of the terms of this EULA. Upon termination of this EULA, all license rights granted to you shall immediately terminate. However, all other provisions of this EULA shall survive such termination.

Export Laws. You acknowledge that the laws and regulations of the United States restrict the export and re-export of commodities and technical data of United States origin. You agree that you will not export or re-export the Software in any form in violation of the laws of the United States or any foreign jurisdiction. By installing or using the Software, you represent and warrant that you are not (a) a national or resident of any country to which the United States has embargoed goods, or (b) on the United States Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Denial and Prohibition Orders.

U.S. Government End Users. The Software and related documentation are “Commercial Items,” as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §§227.7202-1 through 227.7202-4, as applicable, the Software and related documentation are being licensed to U.S. Government end users (a) only as “Commercial Items,” and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

Miscellaneous. This EULA, including the Fullpower privacy policy incorporated by reference, is the entire agreement between you and Fullpower with respect to, and supersedes any previous oral or written communications or documents (including, if you are obtaining an update, any agreement that may have been included with an earlier version of the Software) concerning, the subject matter of this EULA. In no event shall any additional or inconsistent term in any purchase order or similar document submitted by you modify the terms of this EULA. This EULA is governed by the laws of the State of California, USA, as such laws apply to contracts between California residents entered into and performed entirely in California (notwithstanding your place of residency). You agree that any dispute arising from or relating to this EULA shall be brought exclusively in a court of competent jurisdiction, federal or state, located within the State of California, County of San Francisco, and in no other jurisdiction, and you hereby consent to personal jurisdiction and venue in, and agree to service of process issued or authorized by, any such court. This EULA will not be governed by the U.N. Convention on Contracts for the International Sale of Goods. If any provision of this EULA is found to be invalid or unenforceable, it will be enforced to the extent permissible and the remainder of this EULA will remain in full force and effect. Failure by Fullpower to prosecute any right with respect to a default hereunder will not constitute a waiver by Fullpower of the right to enforce rights with respect to the same or any other breach.

End-User Terms Required by Apple. You acknowledge and agree that (i) this EULA is concluded between you and Fullpower, and not Apple, Inc. (“Apple”); (ii) Fullpower, and not Apple, is solely responsible for the Software; (iii) Apple has no responsibility whatsoever to furnish any maintenance and support services with respect to the Software; (iv) in the event of any failure of the Software to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for the Software; (v) to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software; (vi) Apple is not responsible for any claims that you have arising out of your use of the Software; (vii) Apple will have no responsibility whatsoever for the investigation, defense, settlement or discharge of any third-party claim that the Software infringes that third party’s intellectual property rights; and (viii) Apple and its subsidiaries are third party beneficiaries of this EULA and, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary. You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

End-User Terms Required by Microsoft. Fullpower licenses content from Microsoft Corporation (“Microsoft”). During your use of the Software you may encounter and use the Microsoft content, to which the additional terms and conditions found at http://go.microsoft.com/fwlink/?LinkId=21969 will apply. All information collected by Microsoft in connection with your use of the Software (such as, but not limited to, your IP address, request, time of submission and the results returned to you) will be subject to the then-current Microsoft Online Privacy Statement, a current copy of which is available at http://privacy.microsoft.com/en-us/fullnotice.aspx.
